Terms and conditions for using BizOS

These Terms of Service ("Terms") govern your access to and use of BizOS's AI agent platform and services. By using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using BizOS, you agree to:

  • Comply with these Terms and all applicable laws
  • Be at least 18 years old or the age of majority in your jurisdiction
  • Have the authority to enter into this agreement on behalf of your organization
  • Provide accurate and complete information during registration

2. Service Description

BizOS provides an AI-powered business operations platform consisting of:

  • Seven Specialized AI Agents: Alex (Lead Concierge), Sarah (Sales Closer), Mike (Marketing Strategist), Mark (Ads Manager), Stephanie (Social Media), Emily (Customer Success), and David (Analytics Advisor)
  • Multi-Channel Communication: Website chat, SMS, social media platforms, and email
  • CRM & Campaign Management: Contact management, marketing automation, and analytics
  • Human-in-the-Loop Controls: Approval workflows and audit trails

3. Account Responsibilities

You are responsible for:

  • Maintaining the security and confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your use complies with applicable anti-spam and data protection laws
  • Obtaining proper consent before using AI agents to contact individuals

4. Acceptable Use Policy

You agree NOT to use BizOS to:

  • Send spam, unsolicited communications, or violate anti-spam laws
  • Engage in fraudulent, deceptive, or misleading practices
  • Violate any intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to reverse engineer, decompile, or extract the AI models
  • Use the service for illegal activities or regulated industries without proper licensing
  • Scrape, crawl, or harvest data from the platform

5. Subscription and Payment

5.1 Subscription Plans

  • Standard ($97/month): Access to Alex agent, 500 AI responses, 500 CRM contacts
  • Premium ($297/month): All 6 agents, 5,000 AI responses, 10,000 CRM contacts
  • Enterprise (Custom): All 7 agents, unlimited usage, custom terms

5.2 Billing Terms

  • Subscriptions are billed monthly in advance
  • All fees are non-refundable except as required by law
  • Usage beyond plan limits may result in overage charges
  • We may change pricing with 30 days' notice
  • Failed payments may result in service suspension

6. AI Agent Behavior and Limitations

You acknowledge and understand that:

  • AI agents generate responses based on machine learning models and may occasionally produce inaccurate or inappropriate content
  • You are responsible for monitoring and approving agent actions through HITL controls
  • BizOS is not liable for agent-generated content that violates laws or third-party rights
  • You must review and customize agent training data for your specific use case
  • Agents are tools to assist your business, not autonomous decision-makers

7. Data Ownership and License

Your Data: You retain all rights to your customer data, business information, and content uploaded to BizOS.

License to BizOS: You grant us a limited license to process, store, and analyze your data to provide and improve our services.

AI Training: We may use aggregated, anonymized data to improve our AI models, but we will never use your specific customer data to train models for other customers.

8. Service Level Agreement

  • We target 99.9% uptime for Premium and Enterprise plans
  • Scheduled maintenance will be announced at least 24 hours in advance
  • AI response times typically range from 2-10 seconds depending on complexity
  • We reserve the right to modify, suspend, or discontinue features with notice

9. Termination

By You: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

By Us: We may suspend or terminate your account immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay outstanding fees
  • Engage in activity that harms BizOS or other users

Effect of Termination: Upon termination, we will retain your data for 30 days for recovery purposes, after which it will be permanently deleted.

10. Warranties and Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The service will be uninterrupted or error-free
  • AI agents will produce accurate or appropriate responses in all cases
  • The service will meet your specific business requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZOS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from AI agent errors or inappropriate responses

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold BizOS harmless from any claims, losses, or expenses (including legal fees) arising from:

  • Your use of the services
  • Violation of these Terms
  • Content or communications generated by AI agents on your behalf
  • Your violation of applicable laws or third-party rights

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via:

  • Email notification to your registered email address
  • In-app notification upon next login
  • Posted notice on this page with updated "Last updated" date

Continued use of BizOS after changes constitutes acceptance of the updated Terms.
